Former New Star fund manager Patrick Evershed is due to appear at the Court of Appeal today to defend a court ruling that his unfair dismissal case falls under whistleblowing laws.
Evershed claims to have been unfairly ousted from New Star after reporting the firm's founder John Duffield to human resources for staff bullying. New Star denies the allegations.
If the whistleblowing ruling is upheld, Evershed is entitled to potentially unlimited damages from fund manager Henderson, which bought New Star for £115m last year.
Henderson's appeal is the latest episode in the case which was first brought to court 18 months ago. It has not yet received a date to come to court, pending the outcome of the whistleblowing appeal.
Duffield left New Star following the Henderson takeover to set up a new private client venture called Brompton Asset Management.
